BridgeHands Terms of Service and Disclaimer

1.

BridgeHands services are subject to the Terms of Service (TOS) recitals below (2-13, etc.).   BridgeHands services are not guaranteed for all environments and fitness for use.  BridgeHands is dedicated to providing excellent services to its Customers. If you are not satisfied with your purchase and wish receive a pro-rated refund, within 30 day you must contact BridgeHands customer support at one of the following:

To be eligible for a pro-rated refund, you must provide BridgeHands with the following:

a. Customer name, login ID, email address and any other relevant information for us to contact you
    (phone number).
b.  Description of your paid service offering (as BridgeHands Premium, ULTRA or Teacher membership subscription).
c.  Specifics on the reason for your pro-rated refund request.
d.  Name and street address where you wish to receive your pro-rated refund.
e.  Printed name of authorized person receiving the pro-rated refund.

Upon receiving and reviewing your refund request, within 30 days BridgeHands will issue and mail the pro-rated refund.

NOTE: Should you, the Customer, not adhere to the TOS (such as sharing your personal login ID/password), BridgeHands reserves the right to immediately terminate its service without regard to refunds, contract term extensions or other forms of redress.
 

2.

BridgeHands offers Bridge-related communication, content information, links on an "as is" basis.  BridgeHands specifically does not offer or imply any representations or warranties of any kind at its website, EMAIL, telephonic or other forms of communication.  This includes but is not limited to BridgeHands content including, without limitation, warranties of merchantability and fitness for a particular purpose. BridgeHands employs reasonable measures to guard against viruses, "trojan  horses", spyware, keystroke loggers, rogue programs and the like.  None-the-less, BridgeHands cannot assume responsibility for any damages associated with content, information, data, programs, or any other sources nor that of its affiliates, representatives, customers or the like (Parties)

Further, BridgeHands does not represent or warrant that its information or content provided by others is correct, accurate, complete or current. Pricing, availability, packaging, terms and conditions for products and services is subject to change without notice.  See BridgeHands Billing

3.

BridgeHands and its Parties assume no liability for damages arising out of or in connection with this website, EMAIL, telephonic or other forms of communications unless specifically stated to the contrary.  All Parties agree to hold each other harmless for their actions or actions of their agents including but not limited to content, communications, implied or expressed representations.
 

4.

BridgeHands and its Parties agree to hold each other harmless for their actions or actions of their agents including but not limited to content, communications, implied or expressed representations.  This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
 

5.

EXCLUSION OF INCIDENTAL, CONSEQUENTIAL AND CERTAIN OTHER DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BRIDGEHANDS, ITS SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, FOR LOSS OF PRIVACY, FOR FAILURE TO MEET ANY DUTY INCLUDING OF GOOD FAITH OR OF REASONABLE CARE, NEGLIGENCE, AND ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER).

LIMITATION OF LIABILITY AND REMEDIES. NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED ABOVE AND ALL DIRECT OR GENERAL DAMAGES IN CONTRACT OR ANYTHING ELSE), THE ENTIRE LIABILITY OF BRIDGEHANDS, ITS SUPPLIERS, OR AFFILIATES UNDER THE TERMS AND CONDITIONS OF ITS SERVICES AND PRODUCTS IS YOUR EXCLUSIVE REMEDY FOR ALL OF THE FOREGOING SHALL BE LIMITED TO THE GREATER OF THE ACTUAL DAMAGES YOU INCUR IN REASONABLE RELIANCE ON BRIDGEHANDS PRODUCTS AND SERVICES UP TO THE AMOUNT ACTUALLY PAID BY YOU OR U.S.$5.00. THE FOREGOING LIMITATIONS, EXCLUSIONS AND DISCLAIMERS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.  BridgeHands OPERATES WITHIN THE JURISDICTION OF THE STATE OF CALIFORNIA.
 

7.

Customers maintaining their BridgeHands Premiere Club website hosting services via personal FTP ID/passwords should be aware of, and in agreement with BridgeHands Shared Sub-domain Agreement.  EMAIL Sales@BridgeHands.com for a copy.

Web-based customers are responsible for timely backups all data, content, programs, links and the like (Information), stored on their BridgeHands website.

BridgeHands is not liable for Information or acts of other Parties.
 

8.

BridgeHands requires Parties to adhere to the following guidelines:

Content shall adhere to the laws governed within the United States, including but not limited to liable, slander, fraudulent acts, perjury, defamation of character, plagiarism/attribution; copyright, trademark, and patent infringement; indecency, endorsements, accreditation, discrimination, negligence, misrepresentation, binding agreements and other fair business practices in the State of California.

Ensure content adheres to moral and ethical norms within the Bridge community and guidelines by the American Contract Bridge League.

Ensure content maintains privacy of BridgeHands customers including: Names, addresses, telephone numbers, EMAIL addresses, Bridge "handles", Masterpoint or online ratings (Lehman, DAR, etc). Other personal information shall not be submitted on the BridgeHands website or to its customers via EMAIL, telephonic or other communications unless all parties expressly agree to share the specific information provided.  Please see BridgeHands Privacy Statement

Strive to offer fair and balanced content that does not seek to injure the good name of others, their products or their services.
 

9.

BridgeHands and its Web Service Provider absolutely prohibit the sale, display, web links, discussion/content of any of the following:

A. Any item that is harmful to minors, obscene, or otherwise objectionable.

B. Illegal or restricted weapons and related accessories, including the following:

Firearms and firearm accessories
Ammunitions, Scopes, and Silencers
Switchblade knives
Any concealed weapon
Any explosive device
Martial arts weapons

C. Cigarettes, illegal drugs, drug paraphernalia (including items to grow, manufacture, or distribute the same), prescription drugs, and medical devices, including any medical device that requires fitting by a certified practitioner or licensed seller.

D. Any item that violates any U.S. export law or regulation, including any items subject to the terms of the U.S. embargoes against Afghanistan, Cuba, Iran, Iraq, Libya, North Korea, and Sudan.

E. Any item that infringes the rights of a third party, including items that violate copyrights, trademarks, publicity, or privacy rights of third parties. Examples include, but are not limited to: Unauthorized copies of software, music, video games, movies, photos, or other media. Bootleg recordings of concerts, movies, or other performances. Sale of back-up copies of software.

F. Any item that is counterfeit or stolen, including items that are:

"Replicas," "knock-offs," in the same "style" as, or "fake" versions of a name brand product. Counterfeit, or for the purpose of producing counterfeit, currency, stamps, government identification.

G. Inauthentic sports collectibles, celebrity autographs, or otherwise inauthentic versions of memorabilia or other items with inauthentic signatures.

H. Any item for gaining unauthorized entry to a place or vehicle including lock-picking devices, vehicle master keys, and other devices.

I. Any item that promotes, glorifies, or is directly associated with groups or individuals known principally for hateful or violent positions or acts, such as Nazis or the Ku Klux Klan. Official government-issue stamps and coins are not prohibited under this policy. Expressive media, such as books and films, may be subject to more permissive standards as determined by BridgeHands and its Web Service Provider's in its sole discretion.

J. Any animal items that are subject to regulations or laws for the protection of live animals, including endangered species and domesticated animals, as well as any products made from or including any parts of an animal protected by law or regulation.

K. Any item that has been the subject of a product recall by the U.S. Consumer Product Safety Commission, other government agency, or product manufacturer.

L. Any item used for hacking, intercepting, jamming, descrambling, or otherwise obtaining unauthorized access to wire, electronic, or other types of communications.

M. Bodies, body parts, and/or bodily fluids. For example: cadavers, organs, "clean" urine for drug tests, sperm, eggs, blood, breast milk.

N. Fireworks, explosives, or any hazardous material or restricted chemical.

O. Government-issued identification documents, whether authentic or counterfeit (e.g., fake IDs for age verification, fake government credentials, passports, green cards, birth certificates), police badges or insignia, and any other law enforcement items (e.g., FBI identification cards, badges, uniforms, flashing lights/sirens, etc.) generally restricted for sale under federal and state law.

P. Stocks and securities.

Q. Gambling items (lottery tickets, sweepstakes, pyramid schemes, grab bags, raffles, slot machines, etc.).

R. Individual contracts, services, and any item that is non-transferable.

S. Event Tickets may only be sold in accordance with applicable state and local law. All Event Ticket descriptions must contain the location of the event (venue, city and state), date of the event, and face value of the ticket(s).  BridgeHands and its Web Service Provider may restrict the sale to the face value of the ticket(s) and require that merchants enter the face value of the ticket(s) as the "Price" for the item. T. Non-packaged food items and other food or beverage items sold in a manner inconsistent with federal, state, or legal regulations.

U. Any used goods not appropriate for resale for safety, health, or other reasons, including any clothing items that have not been appropriately cleaned (e.g., used underwear).

V. Any other item that violates any applicable federal, state, or local law or regulation or which BridgeHands or its Web Service Provider determines, in its sole discretion, is inappropriate for sale through the services provided by BridgeHands or its Web Service Provider.
 

10.

BridgeHands never originates unsolicited calls or EMAILs customers to obtain financial data such as credit cards, checking or bank account, login identification, passwords, social security numbers, drivers license information, or the like.  Although scams are rare in the Bridge community, always beware of devious individuals using schemes as "phishing" in an attempt to secure identity or financial theft under the purported name of BridgeHands.  Scammers could attempt to send EMAILs using look-alike BridgeHands EMAIL IDs (but not actually using BridgeHands.com address) or fictitious web address (not actually BridgeHands.com).  Remember, BridgeHands never contacts customers for financial information such as credit cards, ID/passwords, or other sensitive private information - you call or EMAIL us to fulfill your order.

11.

BridgeHands does not engage in, support, nor permit unsolicited "spam" EMAIL, junk mail, or telephone solicitations to its customers.
 

12.

BridgeHands services are generally offered on a prorated basis.  In the event BridgeHands terminates a specific service offering to a customer for whatever reason, the customer's refund is limited to their prorated usage.  BridgeHands expressly does not assume responsibility for any subsequent damages claimed by any Parties.
 

13.

BridgeHands uses its best efforts to properly display the correct and current pricing information and terms and conditions on all documentation.  Should BridgeHands inadvertently make a data entry error, fail to show the latest price, or similar circumstance, BridgeHands reserves the right to correct the pricing discrepancy.  Accordingly, BridgeHands customers have the right to cancel orders based on aforementioned changes.
